These Terms of Service (“Terms”) govern your use of services provided by CT Hosting, a division of ClearTech Solutions Pty Ltd. By accessing or using our services, you agree to these Terms. If you do not agree, you must not use our services.

1. Services We Provide

CT Hosting provides:

• Website hosting (shared, VPS, dedicated)
• Domain name registration and management
• Email hosting
• Website and application backups
• SSL certificates
• Website performance and security tools
• Technical support

We reserve the right to modify or discontinue any service with notice.

2. Account Setup and Eligibility

To use our services, you must:

• Be at least 18 years of age
• Provide accurate and complete information during signup
• Keep your contact and billing information up to date

We may suspend or terminate any account with false, misleading or fraudulent information.

3. Domain Registration

By registering a domain with CT Hosting, you agree to the policies of the relevant domain registrar and registry, including but not limited to:

• Domain eligibility requirements (.com.au, .org.au, etc.)
• Timely renewal and payment obligations

Your responsibility to ensure correct domain contact information

We are not liable for loss of domain names due to late renewals or inaccurate details.

4. Service Usage & Restrictions

You agree not to:

• Use hosting for unlawful, abusive or malicious activities
• Send spam or unsolicited emails from our servers
• Host content that infringes copyright, trademarks or violates applicable law

Use excessive server resources that affect other users (as determined by CT Hosting)

We reserve the right to suspend or terminate services if your use violates these terms or impacts system performance or security.

5. Payments, Billing & Renewals

All services are billed in advance and are non-refundable unless otherwise stated in our Refund Policy.

• Prices are in AUD and may be subject to change with notice
• Renewal reminders are issued prior to expiry of hosting and domain services
• Late or failed payments may result in service suspension or cancellation

You are responsible for ensuring payments are processed before the due date to avoid disruption.

6. Cancellations and Terminations

You may cancel services at any time via your client portal or by written request. Cancellation must be received prior to your next billing cycle to avoid further charges.

CT Hosting reserves the right to:

• Suspend or terminate services for breach of these Terms
• Refuse service to any individual or entity at our discretion
• Retain or delete hosting data after service termination

7. Backups & Data Management

While CT Hosting provides automated backups on hosting plans, you are ultimately responsible for:

• Maintaining your own backups
• Ensuring your website and data are secure and up to date

We are not liable for any data loss, corruption, or failure unless caused by proven negligence.

8. Uptime & Support

We strive to maintain reliable services with high uptime and responsive support. However:

• Scheduled maintenance may occasionally cause temporary downtime
• We do not guarantee uninterrupted service availability
• Response times may vary depending on the nature of your request

9. Limitation of Liability

To the fullest extent permitted by law, CT Hosting, ClearTech Solutions Pty Ltd, and its directors, employees, and agents are not liable for:

• Loss of profits, data, or business opportunities
• Service interruptions or performance issues beyond our control
• Damages arising from your misuse of services or failure to secure your data

Our total liability is limited to the amount paid by you for services during the 3 months prior to any claim.

10. Indemnity

You agree to indemnify and hold CT Hosting, ClearTech Solutions Pty Ltd and their representatives harmless from any claims, damages, losses or costs arising from:

• Your use of our services
• Your breach of these Terms or the Acceptable Use Policy
• Content you host or transmit via our infrastructure

11. Changes to Terms

We may update these Terms at any time by posting the revised version on our website. Continued use of our services after changes are made indicates your acceptance.

12. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in the courts of that jurisdiction.
